End of the road for Enola

Just when we thought the decade-long legal wrangle over the controversial “Enola” bean patent had finally been put to rest, it seemed the saga was set to continue.

But we’ve just heard that seed company POD-NERS’ latest legal move – a petition for a panel rehearing – has been denied. In August, the company requested that the United States Court of Appeals for the Federal Circuit reconsider its verdict of 10th July 2009, which upheld an earlier decision to revoke the troublesome bean patent.

This latest decision is a major victory for CIAT, the CGIAR, our partners, breeders and small farmers everywhere.

And this ought to be the end of Enola bean…
